Terms of service
These terms apply to every order placed on batheandbeam.com. Please read them before you buy. Placing an order means you accept them.
1. Who we are
This website is operated by HOMART LIMITED ("we", "us"), registered in England and Wales under company number 15257354, registered office 30 Uphall Road, Ilford, England, IG1 2JF, trading as Bathe & Beam. Contact: support@homartuk.com, 07868 375682.
2. Using this site
You may use this site to browse and place orders for your own use or for your business. You may not use it unlawfully, interfere with it, scrape it systematically, or reproduce our photography, text or technical data without our written permission.
3. Products, ratings and technical data
We publish IP ratings, zone suitability, fire ratings, CRI, colour temperature, lumen output and beam angle as supplied and tested by the manufacturer. Those figures describe the product; they do not constitute a design for your installation.
Deciding which zone a fitting will occupy, and therefore which rating it needs, depends on the geometry of your room and is a matter for you and your electrician. Our zones and IP ratings guide and any advice we give by email or telephone is general guidance to help you choose a product; it is not an electrical design, a survey, or a substitute for the judgement of a qualified person.
Finishes vary slightly between production batches, and the appearance of a light source on a screen is never an exact match for the room.
4. Installation
Except where you have bought one of our installed packages, products are supplied for installation by others. Electrical work in a room containing a bath or shower is notifiable work in England and Wales and must be carried out by a competent person — see our zones guide. We are not liable for loss, damage or injury arising from installation by an unqualified person, from installation in a zone for which the product is not rated, from use of an incompatible dimmer or driver, or from failure to fit a fire hood where one is required.
5. Prices and payment
Prices are in pounds sterling and include VAT where applicable. Delivery charges are shown separately at checkout before you pay. We take payment when you place your order.
If we discover a material pricing error or that an item is out of stock after you have ordered, we will contact you and offer the choice of confirming at the correct price or cancelling for a full refund. We are not obliged to supply at an incorrect price.
6. When a contract is formed
Your order is an offer to buy. Our order confirmation acknowledges receipt but does not form a contract. A contract is formed when we send a dispatch confirmation. If we cannot accept your order we will tell you and refund in full.
7. Delivery and risk
Timescales and charges are on our delivery page. Estimated dates are estimates, not guarantees, and we recommend you do not book an electrician until the goods have arrived and been checked. Risk passes to you on delivery; ownership passes when we have been paid in full.
8. Cancellation, returns and faults
Set out in full on our returns and refunds page, which forms part of these terms.
9. Installed packages
Where you buy a package that includes installation, the work is carried out by a registered electrician. We will agree a date with you in advance, the work will be certified, and the notification required under Part P will be made. Access, a safe working environment and a functioning supply are your responsibility. Additional work found to be necessary once the fitting is opened up — a failed existing circuit, for example — will be quoted before it is carried out.
10. Guarantees
Manufacturer guarantees are stated on each product page, typically five or seven years. A guarantee covers failure in normal use; it does not cover damage in installation, use outside the rated zone, incompatible dimming, or accidental damage. Guarantee claims do not affect your statutory rights.
11. Liability
We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or under the Consumer Rights Act 2015.
If we fail to comply with these terms we are responsible for foreseeable loss or damage caused by our breach. We are not responsible for loss that was not foreseeable. Where you buy as a business we are not liable for loss of profit, loss of business, business interruption or loss of opportunity, and our total liability in connection with an order is limited to the price of that order.
12. Events outside our control
We are not liable for delay or failure caused by an event outside our reasonable control. If one occurs we will contact you and may extend timescales; if the delay is substantial you may cancel for a full refund.
13. Your account
If you create an account you are responsible for keeping your password confidential and for activity under it. Tell us promptly if you believe someone else has accessed it.
14. Intellectual property
All content on this site, including the Bathe & Beam name and logo, photography, guides and product data, is owned by or licensed to us and protected by copyright and trade mark law.
15. Complaints and governing law
Email support@homartuk.com; we acknowledge within two working days and aim to resolve within ten. If you remain unhappy, contact Citizens Advice on 0808 223 1133. These terms are governed by the laws of England and Wales and disputes fall to the courts of England and Wales; if you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
